WOIZZER PRIVACY POLICY

This Privacy Policy applies to the use of the WOIZZER App. “WOIZZER” refers to the WOIZZER technology and/or Woizzer AG. This Privacy Policy supplements the “Terms and Conditions for the Use of WOIZZER”.

1. Basic Principles of WOIZZER Regarding the Processing of Your Personal Data

The protection of personal data is a central concern for WOIZZER. WOIZZER is thus subject to the following basic principles in the protection of your personal data:

WOIZZER collects, processes and uses personal data in compliance with the data protection laws of the Federal Republic of Germany and the data protection provisions of the European Union.

WOIZZER collects, processes and uses personal data exclusively in order to allow for the trouble-free and designated use of the WOIZZER technology. The data communicated by the users is stored by WOIZZER on the WOIZZER servers for this purpose.

With the exception of stating first name, surname and location—information essential for the functionality of WOIZZER and thus obligatory—the user decides which of the personal data entered in WOIZZER (as a voice mail,as attachments with pictures, videos or text, personal details, such as date of birth, gender, status, interests, profile picture or ProfilWOIZZ) can be seen or heard by other WOIZZER users.

WOIZZER users can only see or listen to the personal data of other users that goes beyond their profile information if and to the extent to which they have allowed this by flagging it as “public” with a WOIZZ.

2. Fixed Terms within this Privacy Policy

WOIZZER uses certain fixed terms in this Privacy Policy.

“Personal Data” are all entries regarding your personal and miscellaneous circumstances.

The Application, with which WOIZZER offers the WOIZZER technology, as well as WOIZZER AG are both called “WOIZZER”, individually or collectively.

The user(s) of WOIZZER are called “user(s)”.

Voice mails created with WOIZZER technology, associated picture, video or text attachments and, if desired by the user, the GPS location data, are called “WOIZZ” in the singular and “WOIZZES” in the plural.

The personal data that you have to enter when signing up for the use of WOIZZER (mandatory fields) is called “registration data”.

The profile with which WOIZZER represents the personal data entered by you in accordance with your information and your approval is called “profile”, the data contained within is called “profile data”.

3. Data Collection for the Use of the WOIZZER Technology
In order for the WOIZZER App to function, WOIZZER needs to collect certain personal data for the WOIZZER profile creation and process it. The following data is mandatory for registration:

First name and surname

User location

Moreover, the user can specify the following on a voluntary and not compulsory basis:

Birthday

Gender

Status and interests

Profile photo

ProfilWOIZZ

All data entered by the user is always visible without restrictions for all WOIZZER users. They are saved and processed on the user’s iPhone and with WOIZZER AG. Profile data can be edited, changed and deleted at any time.

4. User Authentication
When the WOIZZER App is started, an automatic check is performed as to whether this App has already been assigned a WOIZZER ID by WOIZZER. This is generated by WOIZZER and always unique worldwide. The data entered by the user and the WOIZZES created by the user are linked to the WOIZZER ID, so that they are always available to the user when using WOIZZER.

5. Accessibility of the Profile Data for Other WOIZZER Users
Each WOIZZER user can search for other WOIZZER users and have their profiles displayed by entering the corresponding profile data and using the “search” function.

6. Storage of Content
After recording, all WOIZZES (including any possible attachments such as image, video, text and the position coordinates of the WOIZZ) along with the hash format of the phone number of the user will be saved onto the iPhone device on which they were created and synchronized with - as well as saved onto the WOIZZER-server. Upon uninstalling WOIZZER, all data created using WOIZZER will be deleted from the device. The WOIZZER-server retains a copy of the data in order to facilitate the possibility of recovering the data for the user. In order to delete all saved data from the device upon handing over the device to another (such as through selling or giving the device away as a gift), the WOIZZER user should delete WOIZZER from the device. As an exception to above, WOIZZER reserves the unconditional right to permanently delete any WOIZZES, which are posted in any area marked “public” (including but not limited to the WOIZZER-Wall or the WOIZZER-Lounge) as well as in any other publicly available or visible area, without prior notice or grounds.

7. Disclosure of Personal Data
WOIZZER will only disclose personal data with which a WOIZZER user can be individually identified, to the extent necessary for WOIZZER use. Moreover, it will not provide personal data to third parties for commercial purposes.

8. Age Restrictions
The use of WOIZZER is restricted to persons who are at least 17 years old. Parents and/or guardians are responsible for the protection of the privacy of their children.

9. Reservation of Right of Modification
WOIZZER reserves the right to revise this Privacy Policy at any time in accordance with the data protection laws, or adjust it pursuant to changes in legal requirements, WOIZZER users will be automatically informed of this at the next program start and also via the WOIZZER news.

This Privacy Policy is available for viewing and printing under www.woizzer.com.
